A few points -
The behind-the-scenes work required to make this suggestion functional for non-legion factions is significant. To start with, a table of all ~50 factions and their areas would need to be setup so people not of that faction could not use shackles outside of their faction areas, and then shackles placed in those areas. Obviously not all factions would have shackles - but many would. Regardless though, I want to see how the current implementation works out before any expansion of the prison shackle system to other factions is considered.
A person does not need to be subdued for a legionnaire to capture them. The reasoning for this is that I believe it shouldn't be terribly uncommon (even in Thay) for law enforcement to arrest an individual without first beating them down - like maybe threats and fear of worse punishment may be enough to stop some violence or resistance from occurring. However, the target does need to be close to the arresting legionnaire, so if they are trying to run away then force will probably be necessary first.
And finally, assassins/slavers/hunters will not strike when your PC is shackled (uncommandable).

When Azura was made LT the sgt said she could use the shackles ow ith her cloak. I clicked on cloak but it showed no option. Dio I have to click and use it on a player? Can I use it on an assassin?

- you must use the cloak on some shackles in your characters tharch
- you then use the cloak on the pc you want to imprison
- you type JAIL followed by the reason for imprisonment (max 120 characters)
- you may not use this procedure on NPC's

Kaleb Kullen was running around the Caravanserai pen just an hour or two ago, killing all the livestock until Tristella shouted over the fence and told him to stop because those weren't his livestock. Then he fled into the inn like a perfect coward, and he must have been cowering inside an inn room because Tristella searched the Caravanserai inside and out but couldn't find him.
Such a pity. She was going to flog him to a weeping pulp and threaten to call the Legion down on him. If only we could have had Cain or Dustin or Azura (and those fearsome prison shackles) around at that hour, huh? :P
