A few points -
The behind-the-scenes work required to make this suggestion functional for non-legion factions is significant. To start with, a table of all ~50 factions and their areas would need to be setup so people not of that faction could not use shackles outside of their faction areas, and then shackles placed in those areas. Obviously not all factions would have shackles - but many would. Regardless though, I want to see how the current implementation works out before any expansion of the prison shackle system to other factions is considered.
A person does not need to be subdued for a legionnaire to capture them. The reasoning for this is that I believe it shouldn't be terribly uncommon (even in Thay) for law enforcement to arrest an individual without first beating them down - like maybe threats and fear of worse punishment may be enough to stop some violence or resistance from occurring. However, the target does need to be close to the arresting legionnaire, so if they are trying to run away then force will probably be necessary first.
And finally, assassins/slavers/hunters will not strike when your PC is shackled (uncommandable).
